1. Acceptance of Terms

We are Myself Study Center Sdn Bhd, and we own and operate this website (“Site”) at tymbaedu.com.

Your use of this Site is subject to these Terms of Use. By using the Site, you are deemed to have accepted and agreed to be bound by these Terms of Use.

We may make changes to these Terms of Use from time to time. We may notify you of such changes by any reasonable means, including by posting the revised version of these Terms of Use on the Site. Your continued use of the Site following any changes will constitute your acceptance of those changes.

2. Ability to Accept the Terms of Use

You affirm that you are either over 18 years of age or possess legal parental or guardian consent and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in these Terms of Use, and to abide by and comply with them.

3. Site Access

You are responsible for all access to the Site using your internet connection, even if the access is made by another person.

We will use reasonable efforts to ensure that the Site is available at all times. However, we cannot guarantee that the Site, or any individual function or feature of the Site, will always be available and/or free from errors.

The Site may be unavailable during periods when we are implementing upgrades or carrying out essential maintenance.

4. Access to the Site Outside Malaysia

We make no representation that the materials available on the Site are appropriate or available for use in locations outside Malaysia.

Accessing the Site from territories where its content is illegal or unlawful is prohibited. If you choose to access the Site from outside Malaysia, you do so on your own initiative and are responsible for complying with all applicable local laws.

5. Your Use of This Site

Your permission to use the Site is personal to you and non-transferable. You may not use the Site for commercial purposes.

Your use of the Site is conditional upon your compliance with the rules of conduct set out in these Terms of Use. You agree that you will not:

• Use the Site for any fraudulent or unlawful purpose.

• Use the Site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including their privacy rights or rights of publicity.

• Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Site, or express or imply that we endorse any statement you make.

• Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available.

If you wish to reverse-engineer any part of the Site to create an interoperable program, you must contact us. We may provide interface data subject to verification of your identity and other relevant information.

• Frame or mirror any part of the Site without our express prior written consent.

• Create a database by systematically downloading and storing content from the Site.

• Use any manual or automated device to gather Site content or reproduce or circumvent the navigational structure or presentation of the Site without our express prior written consent.

Notwithstanding the foregoing, we grant operators of public online search engines limited permission to use search retrieval applications to reproduce materials from the Site solely to the extent necessary to create publicly available searchable indices of such materials in connection with their public online search services.

We reserve the right to revoke these exceptions, either generally or in specific instances.

6. Third-Party Websites

The Site may provide links to other websites and online resources. We are not responsible for and do not endorse such external websites or resources. Your use of third-party websites and resources is at your own risk.

You may create a link to this Site, provided that:

• The link is fair and lawful.

• The link is not misleading or presented in a manner that suggests an association, approval or endorsement by us where none exists.

• The link is not harmful to our reputation or the reputation of any of our affiliates.

• You retain the legal right and technical ability to remove the link immediately upon receiving a request from us.

We reserve the right to require you to remove any link to the Site at any time, and you must immediately comply with any such request.

7. Intellectual Property

The intellectual property rights in the Site and all text, pictures, videos, graphics, user interfaces, visual interfaces, trademarks, logos, applications, programs, computer code and other content made available through the Site are owned by us or our licensors.

You may not reproduce, print or otherwise make copies of any such content without our express prior permission.

8. Limitation of Liability

We provide the Site on an “as is” basis and make no representations regarding the quality, completeness or accuracy of any content made available on the Site.

To the maximum extent permitted by law, we expressly exclude:

• All conditions, warranties and other terms that might otherwise be implied by law into these Terms of Use.

• Any and all liability to you, whether arising under these Terms of Use or otherwise in connection with your use of the Site.

This limitation of liability applies to damages of any kind, including, without limitation, compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property, and claims made by third parties.

Notwithstanding the foregoing, nothing in these Terms of Use is intended to exclude or limit any liability that cannot lawfully be excluded or limited. In particular, none of the exclusions or limitations in this clause are intended to limit any rights you may have as a consumer under Malaysian law or any statutory rights that cannot be excluded.

To the extent that the foregoing limitation of liability is prohibited, our sole obligation to you in respect of damages shall be limited to RM100.

9. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Myself Study Center Sdn Bhd, its directors, officers, employees, affiliates and agents from and against any claims, demands, losses, expenses, damages and costs, including legal fees, resulting directly or indirectly from or arising out of your:

• Violation of these Terms of Use.

• Use of any of our services.

• Use of the Site.

• Use of any content made available on the Site.

10. Collection of Personal Information

We may collect and use information about you in accordance with our Privacy Policy.

11. Duration of Terms

These Terms of Use will remain effective until terminated.

We may, at any time and for any reason, terminate your access to or use of the Site. If we terminate your access to the Site, you will not have the right to bring any claim against us or our affiliates in relation to such termination.

We and our affiliates shall not be liable for the termination of your access to or use of the Site.

12. Online Learning Platform

Access to TYMBAFlex, our online learning platform, is granted only after a student has enrolled and paid the applicable registration fees.

Payments may be made either in full or through an instalment plan stipulated by TYMBA Education and agreed upon by the student.

However, the TYMBA Education website at tymbaedu.com is available for members of the public to browse free of charge.

13. Student Access

TYMBA Education students will be granted access to the online learning platform at flex.tymbaedu.com until the end of the examination week for which they enrolled, as selected during registration.

Students will also be notified through the student platform regarding each subject in which they are enrolled.

14. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have non-exclusive jurisdiction over any claim or dispute arising under or in connection with these Terms of Use.

We comply with the Personal Data Protection Act 2010 (“the Act”) in protecting your personal data. Please refer to our Privacy Notice available at www.tymbaedu.com.
